Terms of Use

1. Introduction

Welcome to Join Your Club ("JYC", "we", "us" or "our"). JYC is a platform that enables users to discover, join and interact with sport communities, clubs, coaches, trainers, gyms and community owners.

By creating an account or using any part of the platform, you agree to these Terms of Use. If you do not agree, you may not use JYC.

3. JYC's Role as Platform and Facilitator

JYC is a platform and facilitator. Unless explicitly stated otherwise, JYC is not the organizer, coach, trainer, seller, provider, medical adviser or safety supervisor of third-party clubs, events, sessions, memberships or services offered through the platform.

Third-party clubs, coaches, trainers, gyms and organizers are responsible for the clubs, events and services they offer through JYC.

4. Account Creation and Minimum Age

You must be at least 16 years old to create an account. If you are under 18, you confirm that your parent or guardian agrees to these Terms on your behalf. We do not knowingly allow accounts for children under 16, and we delete such accounts when we become aware of them.

To use certain features of JYC, you must create an account. You agree that:

You can delete your account at any time from Settings. Deletion removes your profile, posts, runs, messages and any clubs you own. Payment records are retained in anonymised form where the law requires it.

5. User Responsibility for Sport Participation

Sport and physical activity involve risk. By joining an event, session, club or meetup through JYC, you confirm that you are responsible for deciding whether you are physically and mentally able to participate.

JYC does not assess, verify or guarantee your health, fitness level, ability to participate, or readiness for a specific event. You participate at your own risk.

6. Physical Meetups and Offline Interactions

JYC enables users to meet and train in real life. You are responsible for using reasonable care when attending physical events or meeting other users. JYC is not responsible for the conduct, safety practices or decisions of third-party organizers, clubs, coaches or other users.

7. Clubs, Events and Memberships

JYC allows users to discover and join clubs, attend events and purchase memberships. Before joining or purchasing, you should review the organizer, event details, price, and cancellation/refund rules.

Unless JYC is explicitly listed as the organizer, the relevant club or organizer is responsible for delivering the event, session or service.

8. Payments, Refunds and Right of Withdrawal

Paid events, sessions, memberships and other paid services on JYC are processed through Stripe or Apple/Google in-app purchase systems. By completing a payment, you agree to the applicable Payment Terms and Refund & Cancellation Policy.

Event tickets and club memberships are sold by the organizer, not by JYC. Their cancellation and refund rules apply, and are shown before you pay.

If you are a consumer in the EU, you normally have 14 days to withdraw from a distance contract. For a dated event or session taking place inside that period, this right does not apply once the event has started, and you accept this when you book. For subscriptions bought directly from JYC, the 14-day right applies from the date of purchase unless you ask us to start the service immediately and confirm you lose that right.

9. Organizer Obligations

If you create or run a club or event on JYC, you are the organizer and the seller. You are responsible for delivering what you advertise, for the accuracy of your listings and prices, for handling your own refunds and cancellations, and for meeting your own tax and legal obligations. JYC collects a platform fee and, where you subscribe, a subscription fee, and passes the remainder to you through Stripe.

10. User Conduct

You agree not to use JYC for harassment, threats, discrimination, hate speech, sexual misconduct, stalking, spam, scams, fraud, fake events, misleading offers, illegal activity, or any activity that harms users, clubs, organizers or JYC.

JYC may remove content, suspend accounts or restrict access if users violate these Terms.

11. User Content

You remain responsible for content you upload. You confirm you have the rights needed to share your content on JYC. By uploading content, you grant JYC a non-exclusive, worldwide, royalty-free license to host, store, display and use the content for operating and improving the platform.

12. Messaging and Communication

You must not use communication features for harassment, threats, spam, scams, discrimination, sexual misconduct, illegal activity or unwanted pressure to meet.

13. Suspension and Removal

JYC may suspend or terminate access if you breach these Terms, misuse the platform, create safety or fraud risks, or violate applicable law.

14. Limitation of Liability

To the maximum extent permitted by applicable law, JYC is not liable for third-party events, acts or omissions of users or organizers, injuries during third-party events, unsafe offline interactions, or misleading information published by third-party organizers.

15. Changes to JYC

JYC may update these Terms from time to time. If changes are material, we may ask you to accept the updated Terms before continuing.

16. Beta Access and Confidentiality (NDA)

Join Your Club is currently offered as a private beta / early-access product. As an early tester, you may be given access to features, designs, screens, functionality, unreleased content, business concepts, product plans and other non-public information relating to JYC (together, "Confidential Information").

By accepting these Terms, you agree that during the beta period and for two (2) years afterwards you will:

Confidential Information does not include information that: (a) is or becomes public through no fault of yours; (b) you already lawfully held before receiving it from JYC; (c) you independently developed without using the Confidential Information; or (d) you are required to disclose by law or a competent authority, provided you notify us first where lawfully permitted.

If you breach this section, you agree to pay JYC immediately due liquidated damages of EUR 100,000 per breach. The parties agree this amount is a genuine and reasonable pre-estimate of the loss JYC would suffer from unauthorised disclosure or misuse during this sensitive early phase, and is not intended as a punitive penalty. This does not limit JYC's right to claim additional damages where the actual loss is higher, or to seek an injunction to stop or prevent a breach, to the extent permitted by applicable law.

This section survives termination of your account and continues to apply after the beta period ends.

17. Governing Law

These Terms are governed by the laws of the Netherlands. If a dispute arises, please contact us at admin@joinyourclub.com first.
